These Terms and Conditions (“Terms”) apply to all purchases made through Gadgets by Boujee
Designs (“we”, “our”, “us”) for the Retro Handheld Game Console and related accessories. By
placing an order, you agree to these Terms in full.

1. General
– The  Retro Handheld Game Console (“the Product”) is sold as-is and is intended for personal,
recreational use only.
– Purchasers must be of legal age to buy online in their country of residence.
– These Terms are governed by the laws of the Republic of South Africa and international consumer
laws where applicable.
– We reserve the right to amend these Terms at any time without prior notice.

2. Firmware & Software Disclaimer
– We are not responsible for any issues arising from firmware or software updates performed by the
customer after purchase.
– Any modification or installation of alternative systems or firmware voids any warranty or return
claim.
– We are not liable for data loss, corruption, or malfunction caused by third-party firmware or
updates.

3. Limitation of Liability
– We are not liable for any damage, injury, or death resulting from misuse, neglect, or accidents
involving the Product.
– We are not responsible for water damage, choking hazards, or improper handling.

–This product contains small parts that may present a choking hazard. Not suitable for children under 3 years. Adult supervision required.
– Our total liability is limited to the original purchase price of the Product.
– Use of the Product is entirely at the customer’s risk.

4. Warranty & Product Care
– There are no warranties due to the nature of the Product and reliance on customer handling and
software updates.
– Protective accessories are provided to help customers care for their devices; these do not
guarantee protection.
– Damage may still occur due to drops, moisture, or improper use.

5. SD Cards & Software Use
– We use high-quality SD cards; however, malfunctions may still occur.
– Customers are encouraged to back up all games and data.
– We are not responsible for damage caused to devices used for updates or file transfers.

6. Payment & Pricing
– All prices are listed in South African Rand (ZAR) and may include or exclude VAT depending on
your location.
– Payment must be completed before an order is processed.
– We reserve the right to adjust pricing or cancel orders where pricing errors occur.

7. Returns & Refund Policy
– A 7-day return policy applies from delivery date if the following conditions are met:
* Original packaging, labels intact, no physical or malware damage.
* All accessories (SD cards, cables, manuals) must be returned.
– Return shipping cost depends on fault:
* We cover costs if the product was defective on arrival.
* The customer covers costs if the issue is due to misuse or change of mind.
– Pre-orders are non-refundable due to their nature, but may be replaced if defective.

8. Fraud Protection & Verification
– All consoles are inspected, recorded, and sealed before dispatch.
– Returned items are verified by serial number and tamper seals.
– Returns found to be swapped or tampered with will be rejected without refund.
– We may request video proof before approving a return.

9. Shipping & Delivery
– Local delivery target: within 3 business days.
– International delivery times vary by country and customs processing.
– We are not liable for courier delays, customs fees, or incorrect delivery information provided by
customers.

10. Customs, Duties & Import Taxes
– International buyers are responsible for any customs, import duties, or local taxes.
– We are not responsible for delays or additional charges at customs.

11. Risk of Loss
– Risk passes to the customer once the order is handed to the courier or postal service.

12. Privacy Policy
– Personal information is collected for order processing only.
– We do not sell or share your information except as required to fulfill orders.
– Contact details may be used for updates related to your purchase.

13. Environmental Responsibility
– Please dispose of electronic devices and batteries responsibly in accordance with local laws.

14. Governing Law
– These Terms are governed by South African law. Disputes fall under the jurisdiction of South
African courts.

Fraud Prevention Notice:
All consoles are inspected, logged, and sealed before dispatch. Returns are verified against the
original unit supplied. Fraudulent, tampered, or mismatched returns will be refused.
